- Maintains That The Election Was Free and Fair
The Independent National Electoral Commission has filed a 242 page reply dated the 19th day of September 2014 to the Petition filed by the failed Governorship aspirant of the PDP Otunba Iyiola Omisore .
In the reply signed by Chief Gboyega Awomolo SAN; A.B Mahmoud SAN; Dr. Onyechi Ikpeazu SAN; Hassan M. Liman SAN , Ahmed Raji SAN and 17 other lawyers, they raised three preliminary objection to the petition which they hoped to argue at the Pre-hearing Conference. The preliminary objection bothers on striking out certain paragraphs of the petition filed by Iyiola Omisore and the PDP.
According to INEC, paragraphs 8,28,29,30,31,32, and 33 should be struck out on the ground that the facts pleaded therein are pre-election matters,Paragraphs 26,27,35,36,37 and 38 of the petition are imprecise and vague as the polling units affected by the alleged anomalies were not specifically mentioned or identified while paragraphs 30,34,35 and 38 are incompetent for making criminal allegations against persons who are not parties to the petition.
INEC maintained in their reply that the election conducted on the 9th August,2014 was not only free and fair, it is in substantial compliance with the electoral Act. They urge the court to dismiss the petition for lacking in merit and a waste of the precious time of the tribunal.
