FRESH SUIT SEEKS MU' AZU'S OUSTER AS PDP CHAIRMAN

Less than 48 hours after two separate suits challenging the appointment of Alhaji Adamu Mu’azu as the National Chairman of the Peoples Democratic Party was withdrawn at a Federal High Court in the Abuja Division, another fresh suit has been filed before the court seeking the ouster of Mu’azu.
A member of the PDP, Aliyu Garba Gubrin, through his lawyer, Lilian Ojimma, has approached the court saying that Mu’azu cannot preside over the affairs of the party because his appointment as the chairman of the party did not follow due process.
Already, Mu’azu is gearing up to chair the party’s National Convention billed for December 10 and 11, 2014 where President Goodluck Jonathan is expected to emerge as the presidential candidate of the party.
The plaintiff, in the originating summons with suit number FHC/ABJ/CS/821/2014 and dated November 5, 2014, is also challenging the purported resignation of the former National Chairman of the party, Alhaji Bamanga Tukur.
The PDP, through its counsel, Kwor Victor, has filed a memorandum of appearance.
The case has been assigned to Justice Evoh Chukwu.
It is expected to come up on November 12, 2014.
Joined as defendants in the suit are Tukur, Mu’azu and the Independent National Electoral Commission.
The plaintiff, a House of Representatives aspirant, begged the court to determine whether the resignation of Tukur on January 15, 2014 duly complied with Section 47(5) of the Constitution of the party.
Gubrin also asked the court to declare that Tukur’s resignation is invalid for non compliance with the Constitution of the party and the Electoral Act 2010.
The plaintiff asked the court for an order setting aside the resignation of Tukur as the party’s chairman.
He also begged the court for an order stopping INEC from recognizing Mu’azu as the chairman of the party.
Gubrin told the court to restrain Mu’azu from parading himself as the chairman of the PDP.
Last week, two members of the party, who are asking the court to sack Mu’azu, withdrew their suits.
The plaintiffs, Ezinoye Louis Ndubuisi and Emmanuel Onu, said they withdrew the suits in the best interest of the party.
